Susan Brown (University of North Carolina Law School '03) and partner Joshua Levy regularly team up in representing health care clients, including major pharmaceutical manufacturers and pharmacy benefits managers, in connection with government investigations and related civil actions.

Recent highlights of the Litigation Department's health care practice include:

  • Representing George Washington University in a qui tam action alleging false claims for anesthesia services.
  • Obtained dismissal of federal False Claims Act complaint against a large operator of hospitals.
  • Won trial victory for pharmaceutical manufacturer Schering-Plough against claims by the State of West Virginia over allegedly fraudulent drug pricing.
  • Defending large prescription drug benefits manager in claims by New York Attorney General and a multi-district class action over alleged fraud.
  • Successfully defending six university-based physician groups from around the country in a nationwide investigation by the Office of Inspector General for the Department of Health and Human Services.
  • Represented a network of hospitals and affiliated physicians in a seven-day arbitration over a contract dispute with Blue Cross Blue Shield. 
  • Successfully defending a disease management company in a federal criminal investigation and parallel whistleblower lawsuits brought under the Federal Civil False Claims Act in three federal district.
  • Representing a major medical device manufacturer in defense of federal criminal investigation by the U.S. Department of Justice into industry-wide sales and marketing practices.
 
Eric Christofferson (Georgetown University Law Center '02), right, works closely with John Montgomery, the firm's Managing Partner, on civil litigation in several courts against a pharmaceutical manufacturer accused of wholesale price manipulation.
