Recent highlights of the Litigation Department's health
care practice include:
- Representing George Washington University in a qui
tam action alleging false claims for anesthesia services.
- Obtained dismissal of federal False Claims Act complaint against
a large operator of hospitals.
- Won trial victory for pharmaceutical manufacturer Schering-Plough
against claims by the State of West Virginia over allegedly fraudulent
drug pricing.
- Defending large prescription drug benefits manager in claims
by New York Attorney General and a multi-district class action
over alleged fraud.
- Successfully defending six university-based physician groups from
around the country in a nationwide investigation by the Office
of Inspector General for the Department of Health and Human Services.
- Represented a network of hospitals and affiliated physicians
in a seven-day arbitration over a contract dispute with Blue
Cross Blue Shield.
- Successfully defending a disease management company in a federal
criminal investigation and parallel whistleblower lawsuits
brought under the Federal Civil False Claims Act in three federal
district.
- Representing a major medical device manufacturer in
defense of federal criminal investigation by the U.S. Department
of Justice into industry-wide sales and marketing practices.
