What do we do?
We represent clients in the countless types of disputes that arise from their business dealings — including mergers, asset purchases, technology licensing, employment, franchising, leasing, bankruptcy, and manufacturing. We handle litigation and arbitration in venues throughout the United States and abroad, and often call upon our extensive appellate experience. We also help clients avoid such disputes, by advising them on litigation implications and potential pitfalls as they build and run their businesses. Including trial lawyers at the negotiation stage who are knowledgeable about a client's business can help avoid lawsuits and improve the odds for success when a controversy develops.

What have we done lately?
  • Representing TJX in regulatory investigations and lawsuits brought by banks, consumers, and shareholders in the U.S. and abroad relating to an unauthorized computer network intrusion affecting the client's store chains in the U.S., Puerto Rico, Canada, the U.K., and Ireland.   • Defending pharmaceutical manufacturer Schering-Plough in multiple courts against claims of wholesale price manipulation, including a November 2006 bench trial in federal multidistrict litigation. For a description of an associate's role in this matter, click here.

  • Representing underwriters at Lloyd's of London and other insurers in multiple cases over insurance coverage for the World Trade Center following the 9/11 terrorist attack. Recently won Second Circuit affirmance of successful verdict that followed 10-week jury trial. For a description of an associate's role in this matter, click here.

  • Defended Harrah's and other casino owners against claims by compulsive gamblers, including victories in the Fifth and Seventh Circuits. For a description of an associate's role in this litigation, click here.
  • Represented the Boston Red Sox in litigation under the Americans with Disabilities Act concerning access to Fenway Park.

  • Successfully represented the Massachusetts Port Authority in its efforts to construct a controversial new runway at Logan Airport—including winning a trial court verdict and a D.C. Circuit appeal. The runway opened for business in November 2006 following decades of dispute.

  • Won trial victory for a large real estate investment trust (REIT) against HealthSouth over a long-running hospital lease dispute. For a description of an associate's role in this matter, click here.

 
Jared Nagley (Cornell Law School '01) recently teamed with partner Bob Fischler in the firm's New York office to defeat a class action alleging discriminatory hospital pricing. Jared's practice also regularly includes antitrust matters.
