Associate Matt Arnould (Northwestern University School of Law, ‘09) and partner Josh Levy worked closely on a matter where we represented a global pharmaceutical company to resolve all aspects of the U.S. Department of Justice’s investigation of sales and marketing practices related to one of their products.  For a description of Matt’s experience, click here.

Recent highlights of the Litigation Department's Health Care practice include:

  • We represent a national hospital system in an ongoing Department of Justice investigation and parallel qui tam litigation.
  • We are representing a major medical device manufacturer in a federal investigation with regard to allegations of off-label promotion of medical devices.
  • We are representing a medical device manufacturer in connection with federal and state investigations into the manufacturer’s marketing activities and its arrangements with physician-consultants.
  • We are representing a major global health care company in a federal criminal investigation concerning alleged off-label promotion.  We also represent a major pharmaceutical manufacturer in civil litigation brought by the federal government in U.S. District Court for the District of Massachusetts.  The government alleges that the manufacturer committed Medicaid fraud through improper price reporting. 
  • We are representing a major hospital consortium that is the subject of an investigation into potential kickbacks and allegedly improper relationships between a group of hospital-related physicians and pharmaceutical companies.
  • We are representing a multinational medical devices manufacturer operating in more than 90 countries in connection with a joint Department of Justice and SEC global investigation of medical device companies concerning allegations of possible violations of the Foreign Corrupt Practices Act.  For a description of an associate’s role in this matter, click here.
 

Amy Craig (Boalt Hall '06) worked closely with San Francisco partners Michael Wong and Thad Davis and Washington DC partner Mark Popofsky in connection with the defense of a major hospital and its parent corporation in a physician’s antitrust lawsuit based on allegations of bias in the granting of physician privileges, which, the plaintiff alleges, damaged competition by limiting the plaintiff’s ability to practice medicine at the Hospital.
